1. Agreement To These Terms
By accessing or using Arky, creating an account, connecting a store, using the API or SDK, subscribing to a plan, or authorizing a connected service, you agree to these Terms of Use. If you use Arky for a company, agency, client, or other organization, you represent that you have authority to bind that organization.
If you do not agree to these terms, do not use Arky. If you have a separate written agreement or order form with Arky, that agreement controls where it conflicts with these terms.
2. What Arky Provides
Arky is the backend and Admin for custom frontends. Customers use Arky for content, media, forms, commerce, bookings, customer contacts, support, outreach, notifications, action, experiments, workflows, analytics, APIs, SDK helpers, store settings, subscriptions, and connected provider features.
Arky does not own your custom frontend. You decide your website framework, user experience, content, routes, copy, market, business model, and lawful use case.
3. Permitted Use
You may use Arky for any lawful purpose. This includes commercial, internal, agency, client, experimental, creative, operational, storefront, booking, content, marketing, workflow, and connected-service use cases. Arky does not restrict you to a specific industry, audience, frontend stack, or business type unless required by law, platform rules, security needs, or a separate agreement.
4. Your Responsibilities
You are responsible for:
- Your account, store, API tokens, credentials, team members, permissions, and authorized users.
- Your websites, custom frontends, content, media, products, services, forms, workflows, campaigns, support flows, and connected services.
- Having all rights, permissions, notices, lawful bases, consents, licenses, and authorizations needed for the data and content you process through Arky.
- Complying with laws that apply to your use, including privacy, consumer protection, intellectual property, advertising, payment, tax, ecommerce, employment, export, sanctions, accessibility, anti-spam, and platform-specific rules.
- Reviewing and complying with the terms and policies of third-party services that you connect to Arky.
5. Prohibited Use
You may not use Arky to:
- Break the law or help others break the law.
- Infringe, misappropriate, or violate intellectual property, privacy, publicity, contractual, or other rights.
- Send spam, conduct unlawful outreach, manipulate platforms, harass people, impersonate others, or mislead users about who is responsible for content or actions.
- Upload malware, attempt unauthorized access, probe or attack systems, bypass rate limits, disrupt service, or expose secrets or credentials.
- Use connected services in ways that violate provider terms, developer policies, community guidelines, automation rules, review requirements, or approved use cases.
- Resell or provide managed access to Arky in a way that exceeds your plan, violates a third-party platform rule, or creates security, compliance, or operational risk.
- Use third-party platform data for surveillance, unlawful profiling, prohibited advertising, or other restricted uses under that platform's terms.
We may suspend or limit access if we reasonably believe your use creates legal, security, abuse, payment, platform, or service-integrity risk.
6. Customer Content And Data
You retain ownership of the content, media, data, and materials you submit to Arky. You grant Arky the rights needed to host, process, store, display, transmit, transform, publish, deliver, back up, secure, and otherwise operate that content and data for the service and for actions you authorize.
For example, if you schedule a social publication, you authorize Arky to validate the publication, resolve selected media, send the content to the connected platform, and store the provider result. If you configure a workflow, you authorize Arky to run that workflow and send data to the services you choose.
7. Connected Services And Third-Party Providers
Arky connects to third-party services only when configured or authorized by you, your team, or another authorized operator. Third-party services are governed by their own terms, policies, pricing, review decisions, account controls, rate limits, availability, and data practices.
When you connect a provider account, you authorize Arky to use the credentials, tokens, scopes, account metadata, and provider APIs needed to provide the requested service. You may disconnect connected accounts in Admin where supported. Some providers may require you to also revoke permissions or delete content directly in that provider's account settings.
Arky may change, suspend, or remove a connected provider feature if a provider changes its APIs, terms, pricing, review requirements, permissions, or technical behavior, or if continued operation would create risk.
8. Social Publishing
Arky social publishing is designed for authorized publishing to connected destinations such as Facebook Pages, Instagram Business accounts, YouTube channels, TikTok accounts, and X accounts where enabled. You are responsible for the content you create, schedule, publish, or trigger through Arky.
You must have the right to publish the content, media, videos, links, claims, and metadata you send. You must comply with each platform's developer policies, community rules, advertising rules, automation rules, copyright rules, privacy rules, and approved use cases. Arky may validate content before scheduling, but validation does not guarantee legal compliance, provider acceptance, reach, display, delivery, or performance.
9. YouTube API Notice
If you use Arky with YouTube API Services, you agree to be bound by the YouTube Terms of Service and the applicable YouTube API Services Terms of Service. You certify that uploaded content complies with YouTube's terms, including its Community Guidelines, copyright rules, and privacy rules.
10. Accounts, Security, And API Tokens
You are responsible for keeping account credentials, API tokens, secrets, OAuth credentials, and connected account access secure. Do not share credentials with unauthorized people or place secrets in browser code, public repositories, workflow source text, or exposed logs. Notify us promptly if you believe your account, store, token, or connected account has been compromised.
11. Subscriptions, Fees, And Payment
Some Arky features require a paid subscription or usage-based plan. By subscribing, you authorize Arky and its payment processors to charge the fees, taxes, and usage amounts associated with your plan. Subscriptions may renew automatically until canceled. You can manage billing through the available account, Admin, checkout, or billing portal flows, or by contacting us.
Fees are non-refundable except where required by law or expressly stated in a separate agreement. We may change prices or plan limits with notice where required.
12. Arky Intellectual Property
Arky, including its software, Admin, APIs, SDK, documentation, designs, trademarks, logos, and service structure, is owned by Arky or its licensors. These terms do not transfer ownership of Arky intellectual property to you. Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use Arky for your lawful business purposes during your active access to the service.
13. Feedback
If you give us ideas, suggestions, bug reports, or feedback, you allow us to use them without restriction or compensation. We appreciate the help; this clause just keeps product improvement simple.
14. Beta And Preview Features
Some features may be labeled beta, preview, experimental, or early access. These features may change, break, be limited, or be removed. Use them with care in production workflows.
15. Service Availability
We work to keep Arky reliable, but we do not guarantee uninterrupted service. Features may be unavailable because of maintenance, infrastructure issues, provider outages, API changes, account restrictions, review delays, rate limits, security events, or causes outside our control.
16. Privacy
Our Privacy Policy explains how Arky collects, uses, stores, shares, and protects information. By using Arky, you acknowledge the Privacy Policy.
17. Suspension And Termination
You may stop using Arky at any time. We may suspend or terminate access if you violate these terms, fail to pay, create security or legal risk, misuse the service, violate provider policies, or if required by law or a third-party provider. After termination, we may retain or delete data according to the Privacy Policy, your plan, legal requirements, backup practices, and reasonable operational needs.
18. Disclaimers
Arky is provided "as is" and "as available" to the fullest extent allowed by law. We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation. We do not guarantee that third-party platforms will accept, publish, display, deliver, or keep available any content submitted through Arky.
19. Limitation Of Liability
To the fullest extent allowed by law, Arky will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, reputational harm, or third-party platform decisions. To the fullest extent allowed by law, Arky's total liability for claims relating to the service is limited to the amounts you paid to Arky for the service in the three months before the event giving rise to the claim, or USD 100 if you did not pay for the service.
20. Indemnity
You will defend, indemnify, and hold Arky harmless from claims, damages, liabilities, costs, and expenses arising from your content, data, websites, frontends, connected services, workflows, use of Arky, violation of these terms, violation of law, violation of third-party platform rules, or infringement of third-party rights.
21. Changes To These Terms
We may update these terms from time to time. If we make material changes, we will update the date above and provide notice where required. Continued use of Arky after updated terms become effective means you accept the updated terms.
22. Governing Terms
These terms are governed by the laws of the jurisdiction where Arky's contracting entity is established, unless a separate written agreement says otherwise or mandatory law requires a different rule. If any part of these terms is unenforceable, the remaining parts remain in effect.
